Class Cancellations

All class bookings can be cancelled/amended by you (the customer) up to 24 hours before the scheduled class. Beyond this deadline no credits or refunds are able to be made, unless in special circumstances where you have contacted and arranged with management. 

The Hub reserves the right to cancel a lesson no less than 1 hour before class start time, if minimum class numbers are not reached (3 or below). In this case, students who were booked will be given the class credit back and you will have up to 2 weeks to use it for another class. Students will be notified via text. 

If a class is consistently low on numbers, The Hub Studio will reevaluate the schedule and merge classes to make room for a new class or beginners course to run. 

In the case of students unable to use a paid class/membership due to injury or pregnancy, with a doctors note, you will be credited what you were unable to use, for when you return. 

Memberships upgrades, downgrades and cancellations.

Memberships can be upgraded at any time and starts immediately. This may mean you will have a small payment to make depending on how many credits you have already used for the month and the difference in membership costs. 

Membership downgrades and cancellations require at least 30 days notice of payment date. This is after your first initial 3 months of signing up to a membership with us.

Holiday

Our memberships are a monthly direct debit for classes to be used within that month. We do not carry over classes if you do not use them within that time. (See class cancellations above)

Covid

Due to the Covid pandemic, we are following all government guidlines and are doing everything to keep our staff and students safe. Taking part in classes and accepting this waiver confirms you agree to do the same. 

You are taking part in classes at your own risk and the studio cannot be held accountable if anyone is to become unwell. 

Parental Consent & Approach to Learning

You must be over the age of 18. Parental consent will be required for under 18s. A parent/guardian MUST sign this form to give full consent. By agreeing to the terms on behalf of the minor, you have read the terms and conditions on the student’s behalf and are aware of all risks. 

Please note, apart from our childrens ‘evolvers’ sessions, classes are planned with adults in mind, therefore we ask all of our students to be mature in our approach to learning. This means listening carefully to their instructors teaching, asking questions if they are unsure of instructions given, and to act maturely during all classes. All classes are fitness based and there are no sexual references made by instructors. We run separate classes and workshops for heels based exercise. If at any time you are concerned about anything at all, please contact us or your instructor directly, who will pass onto management.

Terms & Conditions

By signing in each week, you declare that you have read, understood and agree to comply with all of the above terms, and those in the Terms and Conditions consent form. 

You will not be permitted to participate if under the influence of alcohol or drugs. 

Instructions must be followed at all times, students must not attempt any exercises other than those taught by the instructor without permission. It is also not acceptable for you to try to ‘teach’ other students in class. All instructors are experienced, qualified and insured. If you or a fellow student is unsure of something, ask your instructor for further help. 

During your exercise program, every effort will be made to assure your safety. However, as with any exercise program, there are risks, including but not limited to increased heart stress and the chance of musculoskeletal injuries. In volunteering to participate in this exercise, you agree that, to your knowledge, you have no limiting physical conditions or disability that would preclude an exercise program. 

A physicians examination is recommended for all participants with any exercise restrictions, including but not limited to any heart problems, high blood pressure, chest pain, dizziness, relevant surgeries, diabetes, asthma, epilepsy, arthritis, or significant injury to any part of the body. 

By signing below, you accept full responsibility for your own health and well-being and you acknowledge an understanding that no responsibility is assumed by the company or any other related agency. The company and other related agencies are released from any liability now or in the future for conditions that may result from participation in any on-site exercise program including but not limited to: heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat exhaustion, injuries to knees, injuries to back, injuries to feet, or any other illness or soreness that may occur, including death. 

By participating in classes, you agree that you are personally and unconditionally assuming responsibility for any harm, damage, injury or loss suffered as a consequence of participating in classes. To the extent permitted by law, you release, indemnify and will keep indemnified The Hub, its franchisees, officers, employees, contractors and agents from and against any claims, rights and causes of action, including claims for negligence arising from your participation in classes. This document may be produced and relied upon as complete defense to any such claim. 

By signing up to classes and memberships you are accepting this agreement you hereby declare that you have read, fully understand and agree to comply with all of the above terms. These policies will also be shown before you are able to book on TeamUp. 

Data Protection

Data Protection: 

“Data Protection Regulation or General Data Protection Regulation (GDPR)” hereafter referred to as the Regulation, means REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the 

processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation); 

“Controller, data controller, processor, data processor, data subject, personal data, special categories of personal data, personal data breach, supervisory authority, processing and appropriate technical and organisational measures”: as set out in the Data Protection Legislation in force at the time; 

“Confidential Information” means all information disclosed by a party to the other party pursuant to this agreement which is either designated as proprietary and/or confidential, or by its nature or the nature of the circumstances surrounding disclosure, should reasonably be understood to be confidential, including (but not limited to), information on products, customer lists, price lists and financial information; 

“Data Protection Legislation”: (i) the Data Protection Act 1998, until the effective date of its repeal (ii) the General Data Protection Regulation ((EU) 2016/679) (GDPR) and any national implementing laws, regulations and secondary legislation, for so long as the GDPR is effective in the UK, and (iii) any successor and supplemental legislation to the Data Protection Act 1998 and the GDPR, in particular the Data Protection Bill 2017-2019 and the E-Privacy Directive (and its proposed replacement), once it becomes law; 

Processing information provided: 

The Processor shall ensure that persons authorised to process the personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality; 

6.2 In particular, the Processor agrees that, save with the prior written authorisation of the

Controller, it shall not disclose any personal data supplied to the Processor by, for, or on behalf of, the Controller to any third party. 

6.3 The Processor shall not make any use of any personal data supplied to it by the Controller otherwise than in connection with the provision of services to the Controller and as agreed in this agreement. 

6.4 The obligations in clauses 6.1, 6.2 and 6.3 above shall continue for a period of [FIVE] years after the cessation of the provision of services by the Processor to the Controller. 6.5 Nothing in this agreement shall prevent either party from complying with any legal obligation imposed by a regulator or court. Both parties shall however, where possible, discuss together the appropriate response to any request from a regulator or court for disclosure of information. 

Our Terms of us: 

As the General Data Protection Regulation (GDPR) – a set of laws passed in the European Union – comes into effect, many pole schools are taking the opportunity to be clear about the data we collect, how we use it and your rights to control that information, 

When you sign up to classes online, you provide data which is kept safely online, and is not kept anywhere on site. At The Hub, we respect your personal data. All personal information is considered confidential and will not be shared for marketing purposes with any other person or company and only used by ourselves and our online booking provider (Team Up). We have never and will never sell it to third parties. 

Your data may be used to contact you periodically regarding classes, workshops, photo shoots, offers etc. and to keep you updated with information that may be of interest to you. You can choose to opt in/out at any time by replying to this email saying “unsubscribe”. 

Furthermore, your consent to be contacted via text, telephone, email, social media or any other means of communications may be withdrawn at any time, and you may request for your data to be deleted at any time. 

By booking with The Hub you hereby declare that you have read, fully understand and agree to comply with all of the above terms.
